After some arguments, Mr. Ankit Jain, learned Senior Counsel appearing for the respondent, on instructions, submits that since the suit before the Trial Court is listed for arguments on preliminary issues, he has no objection to the impugned order being set aside however, without prejudice to the rights and contentions of the respondent as may be available under law.

In view of the above, the appeal is allowed to the aforesaid extent. 3.

Needless to state, this Court has not expressed any opinion on the merits of the case.
