O R D E R
% 17.11.2025 CM APPL. 71866/2025 By way of the present application filed under section 151 of the Code of Civil Procedure 1908 ('CPC'), the applicant/respondent seeks release of amount of Rs. 7.75 lacs, out of total amount of Rs. 10 lacs, deposited by the appellant in compliance of order dated 21.03.2025, in favour of the respondent.

Mr. N.K. Aggarwal, learned counsel for the respondent draws attention to settlement dated 07.11.2025 signed between the parties through mediation under the aegis of Delhi Mediation Centre, Dwarka Courts, Delhi; and in particular to Clause 6 (ii) of that settlement which recites to the same effect.

Mr. Zahid Ali, learned counsel for the appellant is present. He confirms the settlement terms as comprised in the settlement dated 07.11.2025.

Furthermore, Mr. Aggarwal submits that the remaining amount lying deposited in the court along with upto-date interest, out of Rs. 10 lacs, be released in favour of the appellant.

In view of settlement dated 07.11.2025, a copy which has been appended to the present application, the application is allowed. 6.
Registry is directed to release the amount of Rs.7.75 lacs in favour of the respondent and the balance amount lying deposited with upto-date interest, in favour of the appellant within two weeks of the parties approaching them for the purpose, after duly verifying the credentials of the parties.

The application is disposed-of.

In view of settlement dated 07.11.2025, learned counsel for the appellant seeks leave to withdraw the present appeal. 9.
Appeal is accordingly disposed of as withdrawn. 10.
Pending applications, if any, stand disposed-of. 11.
In view of the settlement, the Registry is directed to refund the entire court fee to the appellant in terms of Section 16 of the Court Fees Act, 1870 within 02 weeks.

Let the requisite certificate of refund be drawn up within 02 weeks of the appellant approaching the Registry for the said purpose. 13.
The date of 08.12.2025 given earlier, stands cancelled.
