This application has been filed on behalf of the plaintiff under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 ['CPC'] in terms of which the plaintiff seeks to withdraw the present suit in view of the fact that an out-of-court settlement has been arrived at between the plaintiff and the defendants.

For the reasons stated, the application is allowed and the plaintiff is permitted to withdraw the suit.

In view of the order passed by above, the suit is dismissed as withdrawn.
