The accused/applicant seeks regular bail in case FIR No. 446/2025 of Police Station Kanjhawala for offence under Section 105 BNS. 2.

In furtherance of last order, learned counsel for accused/applicant submits that on 15.04.2026, the learned presiding officer of the trial court was on leave, so the trial was adjourned for consideration of charge. 4.
Today, learned APP has shown me the FSL report. 5.
It is submitted by both sides that as was recorded on last date, in view of peculiar factual matrix of this case, any view taken by this court would have a bearing on the consideration of charge. counsel for accused/applicant seeks permission to withdraw this bail application with liberty to file afresh before the trial court after framing of charges. It is made clear that withdrawal of the present application shall not be taken as lack of merits in the case of the accused/applicant. 6.
As requested, the application is dismissed as withdrawn with liberty as sought.

Further, learned trial court is requested to decide on the issue of charge as expeditiously as possible and positively on the next date fixed before it.
