% 18.03.2019 The appellant is aggrieved by the order dated 14.12.2018, directing him to deposit arrears of rent @ Rs.8,800/- per month from January, 2013 till December, 2018, within three months from the date of the order. The amount is to be deposited in the Court.
The learned counsel for the appellant submits that the appellant has been in possession of the property since some years; he claims to have been inducted by one Shyam Lal; however, documents show that Shyam Lal was not the owner of the property. The issue is yet to be determined. The appellant is ultimately only a tenant and not the owner of the property, nor has he asserted ownership of the suit property by adverse possession. The learned counsel for the appellant submits that whosoever claiming the rights of a landlord, would have proven the same by way of
documents.
Be that as it may, the Court does not find any reason to interfere with the impugned order.
At this stage, the learned counsel for the appellant seeks to withdraw the appeal.
The appeal stands dismissed as withdrawn.
