% 14.07.2017 This is an application under Section 438 Cr.P.C. filed on behalf of the petitioner for grant of anticipatory bail to the petitioner in case FIR No.315/2016, under Section 307/506/34 IPC & Sections 25/27/54/59 Arms Act, registered at Police Station-Karawal Nagar, Delhi. Learned counsel for the petitioner submits that the petitioner is an innocent person having no nexus with the aforementioned FIR. He further submits that the petitioner has already joined the investigation and that he is not required for any custodial investigation. He further submits that the injured has already been discharged from the hospital. He further submits that the allegations alleged in the FIR are totally false. He also submits that the petitioner is ready to abide by any condition(s), if any, imposed by this Court and prays that the petitioner be granted anticipatory bail. On the other hand, learned APP for the State vehemently opposes the bail application. He, however, on instructions from the IO admits the factum
of joining the investigation by the petitioner. Looking into the above facts and circumstances of the case, the petitioner is directed to join the investigation and in the event of his arrest he be released on anticipatory bail in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the Investigating Officer/SHO concerned with the conditions that he shall not influence the prosecution witnesses; he shall not contact, threaten or coerce the victim/complainant or any of his/her family members; he shall not indulge in any illegal activities; he shall not leave India without prior permission of the concerned Court. The present bail application is allowed and disposed of accordingly. All the pending application(s), if any, also stand disposed of. Copy of this order be given dasti.
