% 15.10.2019 IA 14241/2019 This is a joint application filed by the parties under Order XXIII Rule 3 read with Section 151 CPC through their counsels with the following prayers:
"It is, therefore, most respectfully prayed before this Hon'ble court that this Hon'ble Court may be graciously be pleased to: a) allow the present application;
b) record the compromise, forming part of the settlement deed entered between the parties and direct the same to be binding upon both the parties;
c) pass any other or further order which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."
Learned counsel for the parties states in view of the settlement
agreement dated September 24, 2019 (at Page 193 of Part 2(A) (of IA Part) of the paper book), which shall be adhered to by the parties, the Suit be dismissed as withdrawn. Taking the submission on record, the Suit is dismissed as withdrawn.
Application stands disposed of.
The next date of hearing fixed in this case, i.e., November 29, 2019 stands cancelled.
