The petitioner has filed the present petition, inter alia, praying that the petitioner be released on anticipatory bail in connection with FIR No.0373/2019, under Sections 308/34 of the IPC, registered with PS Kalyanpuri.

The said FIR was lodged after reporting of an incident wherein the petitioner along with three other co-accused, had allegedly thrown bricks on the complainant and his brother and had assaulted them with a sharp weapon.

It is pointed out that two of the other co-accused were arrested and were granted bail by the concerned Court. One of the co-accused (Sanjay) was granted anticipatory bail by an order dated 13.02.2020 passed in Bail Application No.329/2020. It is also asserted that the petitioner has entered into a settlement with the complainant and, although, petitioner's application for quashing of the FIR was rejected, the complainant has no grievances against the petitioner.

Considering that all the three co-accused have been granted bail/anticipatory bail, this Court considers it apposite to allow the present petition.

Accordingly, the petitioner is granted anticipatory bail on his furnishing Personal Bond in the sum of ₹15,000/- with one surety of an equivalent amount to the satisfaction of the concerned SHO/Investigating Officer.

This is also subject to the petitioner joining the investigation and continuing to cooperate with the Investigating Officer. The petitioner shall provide his contact number and ensure that he is reachable at all times. The petitioner shall not leave the National Capital Territory of Delhi and report to the concerned police station, as and when required. 7.
