Though the present petition was filed in the year 2022 challenging the summoning Order dated 10.07.2017. In view of the fact that no stay was granted by this Court, notice has been framed and the matter is now fixed for complainant evidence.

Learned Counsel for the Petitioner seeks permission to withdraw the present petition with liberty to raise all the contentions raised in this petition at an appropriate stage including the fact that the Petitioner was not responsible for the conduct of the affairs of the company on the date when the cheque was dishonoured and thereby offence under Section 138 of the NI Act is not made out against the Petitioner. 3.
Permission and liberty, as prayed for, is granted. 4.

It is stated by learned Counsel for the Petitioner that the Petitioner is a single lady. It is always open for the Petitioner to move an application for exemption which shall be considered by the Trial Court on its own merits depending upon the stage of the case.
