This is an application filed under Section 151 of CPC, 1908 seeking withdrawal of the petition and return of Rs. 10 lakhs lying with the Bank of Baroda as security deposit.

For the reasons stated in the application, issue notice. 3.

Mr. Birat, learned counsel accepts notice for the respondent Nos. 1 and 2. Mr. Aggarwal, learned counsel accepts notice on behalf of the respondent No. 4. Mr. Kumar, learned counsel accepts notice on behalf of the respondent No.5.

Mr. Aggarwal, learned counsel, opposes the present application. 5.

I am of the view that the Bank of Baroda has no locus to oppose the application.

In the present case, the amount of Rs. 10 lakhs was deposited by the petitioners as a security for travelling abroad. The petitioners have travelled abroad and have returned.

Since the petitioners seek to withdraw the present petition, the present petition is dismissed as withdrawn and the amount of Rs. 10 lakhs deposited with the Bank of Baroda, Mumbai Branch for security shall be returned to the petitioners expeditiously and not later than 4 weeks from today.

Needles to state, that the petitioners are at liberty to avail of all their legal rights in accordance with law as the Court has not examined the merits of the controversy.
