The learned counsel appearing for the respondents has handed over a Trade Notice No. 06/2018 dated 08.05.2017, directing all concerned officers and authorities to re-examine the cases in the light of the decision in Director General of Foreign Trade v Kanak Exports: (2016) 2SCC 226 whereby the Supreme Court has held that the notification no. 48/2005 dated 20.02.2006, and notification no. 08/2006 dated 12.06.2006, cannot be applied retrospectively.

In this view, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to apply afresh if any grievance survives. 3.
