% 01.04.2024 1.

The present petition under Section 397/401 CrPC read with Section 19(4) of the Family Courts Act, 1984 seeks the following prayers: "It is, therefore, most respectfully prayed that this Hon'ble Court may be pleased to:

(a) Admit this present revision and call for the records from the Trial Court if this Hon'ble Court deemed fit in the interest of justice.

(b) Set aside/ quash the impugned order date 18.1.2020 passed by the Ld. Trial Court of Shri Pitamber Dutt Ld. Family Judge, Dwarka Court, New Delhi against the revisionist/ petitioner. Any other order/s, which this Hon'ble Court deem fit and proper may also be passed in the favour of the revisionist/ petitioner." 2.

With the consent of the parties, the following directions are passed in the present petition:

a) The order dated 18.01.2020 passed by the learned Judge Family Court, South-West District, Dwarka Courts, New Delhi in Mt. No.437/19 is set aside;

b) The matter is remanded back to the learned Trial Court; c) The petition under Section 125 of the Cr.P.C. filed on behalf of the petitioners is restored to its original number before the learned Trial Court;

d) The aforesaid directions are subject to the petitioners paying a cost of Rs. 15,000/- to the respondent herein, before the learned Trial Court on the next of hearing;

e) The parties are hereby directed to appear before the learned Trial Court on 15.04.2024 at 02:30 P.M.

The present petition is disposed of with the aforesaid directions. 4.
