Heard. Perused.

The petitioner has been sent up for trial, along with others including Sanjay Sharma, through the charge-sheet dated 09.02.2019 submitted upon conclusion of investigation into FIR no. 453/2018 of police station Palam Village involving offences under Sections 307/34 of Indian Penal Code, 1860 (IPC) and Sections 25 and 27 of Arms Act. As per the accusations in the said case, based on the evidence collected, two persons named Tushar Bhardwaj and Sanky Bhardwaj had sustained fire arm injuries, the use of a fire arm being attributed to Sanjay Sharma. There is evidence available to show that when a scuffle had broken out, the petitioner along with certain others had accompanied Sanjay Sharma to the place, Sanjay Sharma openly BAIL APPLN. 702/2019

using the said weapon to first fire in the air, upon which the public persons started running away, use of fire arm causing injuries following after open threats had been extended to which the petitioner was also a party. In the facts and circumstances, denial of bail by the court of sessions by order dated 22.02.2019 is appropriate. No good ground to release the petitioner on bail.
