W.P.(CRL) 1167/2026 After a brief hearing in the matter, it transpires that the essence of the petitioner's allegation is that despite a cognizable offence being disclosed, the police have failed to lodge an FIR.

However, upon query, Mr. Rajbir Singh Bal, learned counsel for the petitioner confirms that the petitioner never moved an application under section 175(3) read with section 223 of the Bharatiya Nagarik Suraksha Sanhita 2023 ('BNSS') before the learned Magistrate. In view of the law laid down by the Supreme Court in Sakiri Vasu vs. State of Uttar Pradesh & Ors.,1 this court is not inclined to entertain the present petition, at least at this stage.

The petition is accordingly disposed-of granting to the petitioner liberty to approach the jurisdictional Magistrate for appropriate relief, with liberty to approach this court later, if so advised, in accordance with law. Pending applications, if any, also stand disposed-of.
