% 19.03.2019 In view of para 12 of the order dated 7th March, 2019 in CS(Comm) No.120/2019 tilted as Boxing Federation of India v. Indian Amateur Boxing Federation & Ors wherein the petitioner is restrained from using the word "Indian" as part of the name of the federation, learned counsel for the petitioner intends to withdraw the petition with a liberty to avail appropriate remedies as per law. Para 12 of the order is as under :

12. Accordingly, till the next date of hearing, Defendant No.1 and its office bearers are restrained from using the word "INDIA‟ or "INDIAN‟ as part of the name of their federation. Defendant No.1 is further restrained from representing in any manner whatsoever that it is a recognized National Sport Federation either by IOA,

Ministry of Youth Affairs and Sports or by the AIBA. The participants in the boxing tournaments, which are being conducted by Defendant no.1 in Jabalpur, shall be clearly informed by the Defendant No.1 that it not the recognized National Sports Federation for the Sport of Boxing in India and Defendant no.1 shall also communicate the present order to all the participants and Boxing Associations across the country. Compliance shall be reported within one month.

In the circumstances, the petition stands dismissed as withdrawn with liberty as prayed for.

Pending application also stands disposed of.
