The present writ petition has been filed seeking a direction to the respondent-MCD to stop the ongoing unauthorized construction being carried out by respondent no.3 at the property bearing Khasra no. 334, 336, 338, 345 and 350 (Bhardwaj Farms) Vasant Kunj Road, Mehrauli (near Chattarpur metro station), Delhi -110030.

It is stated that the petitioner and respondent no.3 are the co-owners of the subject property and there is an ongoing suit for partition and permanent injunction in respect of the subject property. Mr. Vikas Chopra, counsel appearing on behalf of the respondentMCD on advance notice, submits that the unauthorized construction in the subject property has been booked and a show cause notice has been issued. 4.

The respondent no.3 has filed a reply to the aforesaid show cause notice and a personal hearing has been fixed on 21st April, 2026. 5.

In view thereof, the present writ petition is disposed of while directing the respondent-MCD to take appropriate action in accordance with law. 6.

Liberty is given to the petitioner to take appropriate remedies as per law in the event the petitioner has further grievance. 7.

All rights, contentions and legal remedies of respondent no.3 are kept open.
