O R D E R

% 25.04.2019 This order is in continuance of the order of 19th March, 2019. This petition has been entertained on the quantum of sentence only. For the offence under Section 509 of IPC, petitioner has been sentenced to simple imprisonment for three months and fine of ₹5,000/- with default clause. It is pointed out that petitioner was taken into custody on 26th February, 2019 and by now, petitioner has remained behind bars for two months. In the facts and circumstances of this case, it is a fit case to reduce substantive sentence awarded to petitioner to the period already undergone by him subject to deposit of fine, if not already deposited. The impugned orders of 26th February, 2019 and 24th August, 2018 are accordingly modified. Petitioner be released from jail forthwith, if not wanted in any other case. The concerned Jail Superintendent be apprised of this order forthwith to ensure its compliance. CRL.REV.P. 323/2019

With aforesaid modification, this petition stands disposed of. DASTI.
