The present writ petition has been filed seeking a direction to the respondent/MCD to demolish the unauthorized construction being carried out on the ground floor of the property bearing no.8551, situated at Ward No.XII, Near Bhar Garh, Roshanara Road, Delhi-110007 (hereinafter the 'subject property').

To be noted, the petitioner has not impleaded the owner of the property in respect of which demolition is sought. 3.
A complaint has been filed with the respondent/MCD on 6th April, 2026 and immediately thereafter, the present writ petition has been filed on 8th April, 2026.

Therefore, the present writ petition is premature. 4.
The respondent/MCD shall deal with the complaint filed by the petitioner in accordance with law.

In view thereof, counsel for the petitioner seeks to withdraw the present writ petition with liberty to file a fresh writ petition, if necessary, with better particulars.

The petition is dismissed as withdrawn with the aforesaid liberty. 7.
Consequently, all pending application(s) stand disposed of.
