The present writ petition has been filed seeking a direction to the respondent/ MCD to stop unauthorized construction going on in the property bearing no.24/1, Saidulajab, Opposite Anupam apartment, Gate No. 4, IGNOU Road, New Delhi-110030 (hereinafter 'subject property'). 2.

Mr. Roshan Lal Goel, counsel appearing on behalf of the respondent/ MCD submits that no construction whatsoever is going on in the subject property. He further submits that the present writ petition has been filed on account of a private dispute between the landlord and the tenant of the subject property.

To be noted, the petitioner has not impleaded the owner of the subject property in respect of which demolition is sought. In view thereof, counsel for the petitioner seeks to withdraw the present writ petition with liberty to file a fresh petition, if necessary, with better particulars.
