O R D E R

The present application has been filed under Section 439 Cr.P.C. seeking interim bail in FIR No. 98/2019 under Sections 302/323/34 IPC and Sections 25/27/54/59 of the Arms Act registered at P.S. Jahangir Puri on the of ground of surgery of the applicant's wife. 2.

Learned counsel for the applicant submits that the applicant's wife has been advised surgery for micro-discectomy dissection with local steroid infiltration with ozone therapy on 16.03.2020. Learned counsel further submits that the applicant was released earlier also on interim bail vide order dated 02.12.2019 and he has not misused the said concession. 3.

Status report has been filed verifying the medical documents of the applicant's wife. It has further been stated that there is no other male member in the family and the applicant's father expired about three years ago. The applicant's wife is living with five children aged between 08-13 years.

In view of the facts and circumstances of the case, the applicant is admitted to interim bail for a period of seven days from the date of his release, subject to his furnishing a personal bond in the sum of Rs.15,000/-

with one surety in the like amount to the satisfaction of the concerned Jail Superintendent and subject to the following further conditions:- (i) The applicant shall report to the concerned IO/SHO, PS Jahangir Puri, Delhi every morning at 10.00 AM.

(ii) The applicant shall provide the I.O./SHO, PS Jahangir Puri with his mobile phone number, which he undertakes to keep operational during the period of his release.

(iii) The applicant shall not directly or indirectly make any inducement, threat or promises to the complainant or any witness during this period or tamper with the evidence.

(iv) The applicant shall not leave the jurisdiction of the National Capital Territory of Delhi.

(v) In case the surgery is not performed on 16.03.2020, the applicant shall surrender before the concerned Jail Superintendent on 16.03.2020 itself. (vi) The applicant shall surrender before the concerned Jail Superintendent after expiry of the interim bail period. 5.

With the above directions, the bail application is disposed of. 6.
