The present application has been moved by respondent Nos.1 and 2 seeking vacation of stay of order dated 02.05.2024 passed by this Court.

It has been informed that earlier the grievance of the present petitioner/objector was merely limited to the effect that the goods should not be auctioned till her objections are decided by learned Executing Court.

It has now been informed that learned Executing Court has already decided the objections against the Objector and even such order has been challenged by her by filing a separate petition i.e. CM(M) CM(M) 2179/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Learned counsel for the petitioner, who appears on advance notice, does not dispute the abovesaid fact. He does admit that against the dismissal of her objection petition, he has already filed a separate substantive petition and that the present petition has, virtually, becomes infructuous. He, however, submits that since the goods might be auctioned and his such new petition is now listed for 18.07.2025, he may be protected till next date of hearing only. 5.

Sh. Jain, learned counsel for respondent Nos.1 and 2 submits that though the contention made in this regard lacks any merit and substance but, if so directed, he would advise his client to hold on the auction till 18.07.2025. He, however, submits that on such date of hearing i.e. 18.07.2025, the abovesaid new petition may be heard and disposed of as well.

Learned counsel for the petitioner submits that he would render best cooperation on the next date of hearing. 7.

In view of the above, as far as the present petition i.e. CM(M) 2179/2024 is concerned, it stands disposed of as having become infructuous.

However, Registry shall ensure that the connected petition i.e. CM(M) 562/2025, which is listed on 18.07.2025, is shown in supplementary list that day.
