By way of the present petition, the petitioners seek quashing of the FIR bearing No. 673/2024, registered at Police Station Alipur, Delhi, for the commission of offence punishable under Section 106(1) of the Bharatiya Nyaya Sanhita, 2023 (hereafter „BNS‟) and all consequential proceedings emanating therefrom on the basis of settlement arrived at between the parties.

Brief facts of the case are that the petitioner is the owner of Nitin International Godown, where large paper rolls weighing several tonnes are stored. It is stated that the son of respondent no. 2, namely late Sh. Suraj, was employed at the said godown. On 28.10.2024, during the course of his employment and while performing his duties at the workplace, Suraj unfortunately lost his life due to unintentional and unavoidable circumstances. Thereafter, the present FIR was registered against the petitioner under the relevant Sections. It is also stated that the respondent nos. 2 to 4 also filed a claim for compensation before the Commissioner, Employees‟ Compensation, District North, Govt. Of NCT of Delhi. It is stated that with intervention of the respected members of the society, the parties have now amicably settled their dispute vide Memorandum of Understanding (MoU) dated 08.04.2025.

On a query made by this Court, respondent nos. 2 to 4 who have been identified by the IO, have categorically stated that they have entered into compromise out of their own free will and without any pressure, coercion or threat. It is stated that the respondent no. 2 has received the remaining amount of ₹6,00,000/-, out of which ₹2,50,000/- has been paid by the petitioner through Demand Draft (DD) bearing No. 000358 dated 07.02.2026, a sum of ₹3,30,000/- has been transferred via RTGS vide Reference No. 0000000000000123, and the remaining ₹20,000/- has been paid in cash. Therefore, they have no objection if the present FIR is quashed. 6.

Accordingly, FIR bearing No. 673/2024, registered at Police Station Alipur, Delhi, for the commission of offence punishable under Section 106(1) of BNS and all consequential proceedings emanating therefrom are quashed.
