% 05.04.2018 The petitioners who are major and have married of their own free will contrary to the wishes of respondents No.2 to 5 sought protection on the basis of the threats extended by their family members. Notice to respondents No.2 to 5 could not be served as the process fee was under objection. A status report has been filed. As per the status report FIR No.30/2018 under Section 365 IPC was filed by the father of petitioner No.1. During the course of investigation statement of petitioner No.1 under Section 164 CrPC has been recorded wherein she has stated that she has married petitioner No.2 of her own free will. Since the petitioner No.1 is a W.P.(CRL) 251/2018
major the statement of father of petitioner No.1 has been recorded who stated that he has no objection to the marriage of petitioner No.1 since she is a major. As per the status report in view of the statement of the petitioner No.1 recorded under Section 164 CrPC FIR No.30/2018 under Section 365 IPC registered at P.S. Shakar Pur has been cancelled. Learned Additional Standing Counsel on instructions from the Investigating Officer states that the cancellation report will be filed within one week.
In view of the statement of learned Additional Standing Counsel, on instructions learned counsel for the petitioners submits that petitioners do not press the present petition.
The petition is dismissed as infructuous.
