O R D E R

An affidavit has been filed on behalf of respondent stating that the end-of-life vehicle was impounded on 20th April 2023, since no undertaking was received within 90 days.

Further, the vehicle was scrapped on 31st July 2023 by respondent no.2-M/s. Bharat Scrap Facilities, however, the value of scrap has not been provided to the petitioner. Petitioner is entitled to receive the scrap value for which an application shall be made directly on the portal of the department. 3.

Considering that petitioner is present before this Court, petitioner has a right to write a communication addressed to the counsel for respondentTransport Department placing his case for scrap value and/or compensation. 4.

Based on the response, that will be sent within a week thereafter, he will be entitled to pursue remedies in accordance with law. 5.

As per the report filed by the respondent, the scrapping date is 11th June 2023, which was prior to the judgment dated 22nd August 2023, and, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. therefore, there was no information on that date to the petitioner, the petition itself would have been infructuous.

The issue which arises in this matter is that there is no system in place for informing the persons whose private vehicles are seized and the process to be deployed for release of their vehicle, on an undertaking or otherwise to receive the scrap value.

Counsel for the respondent states that now the information regarding the process is on the portal. However, it is directed that Transport Department shall completely review this process and issue proper communication at the stage of seizing a vehicle and also make it fully visible on their portal, all the applicable rules and the processes which need to be undertaken by a person whose vehicles have been impounded. 8.

These directions are issued in public interest considering that multiple matters are being dealt with by Courts, which have similar circumstances.

Petition stands disposed of in above terms with liberty granted to the petitioner, as noted above.
