Petition under Section 528 BNSS has been filed on behalf of the Petitioner for quashing of FIR No.0890/2024, under Sections 420/468/471/ 506 IPC, registered at PS: Karol Bagh and all the consequential proceedings emanating therefrom, in view of the Settlement Agreement dated 23.12.2024.

On advance Notice, learned APP for the State and learned counsel for Respondent No.2 have appeared and accept the Notice. 6.
Petitioner and Respondent No.2 are present in person. 7.

the Petitioner and husband of Resopndent No.2 for purchase of property in the sum of Rs.12,00,000/-. Though, neither the agreement was executed nor the property was handed over to the complainant. However, now the matter has been amicably settled between the parties vide Order dated 23.12.2024 passed by learned ASJ, Tis Hazari Courts and Rs.12,00,000/- have been returned to the Complainant by Petitioner.

Today, Respondent No. 2 is present in the Court and has been identified by the Investigating Officer, she states that she has received the full amount and has no objection if the FIR in question is quashed. 9.
The Statement of the parties have already been recorded before the learned ASJ while granting bail vide Order dated 23.12.2024. They have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 10.
Considering that the parties have settled the matter, FIR No.0890/2024, under Sections 420/468/471/506 IPC, registered at PS: Karol Bagh and all consequential proceedings emanating therefrom are quashed. 11.
The Petition alongwith pending Application is disposed of accordingly.
