This Writ Court has been moved to seek the following reliefs: "A. Issue a writ of mandamus, or any other appropriate writ, order or direction to the respondent to immediately restore the road in front of the house cum office of the petitioner situated at A- 1/5, Model Town-I, Delhi-110009 and remove the dust and gravel left on the side of the road by the respondent.

B. Issue a writ of mandamus, or any other appropriate writ, order or direction to the respondent to make SOP (Standard Operating Procedure) to resurface road immediately after scrapping. " [Emphasis supplied] 2.

The grievance of the petitioner is with respect to the purported "menace" created by the respondent and its agents in front of his house cum office situated at A-1/5, Model Town-I, Delhi-110009 ("said Premises"). is contended that in the night of 31.03.2026, the respondent through its contractor started to repair the road in front of the said Premises. In doing so, the surface of the road was scrapped off for a fresh layer of bitumen. The whole road, it is claimed, to have become unpaved, and also a health hazard. The petitioner is also aggrieved by the respondent not sprinkling water to settle the dust, as also the acts of the respondent which are "completely casual and arbitrary".

Mr. Shashi Pratap Singh, learned counsel for the GNCTD has submitted that a few measures have been taken and has shown photographs which justify the steps taken by them.

The Court, however, finds that even if the petitioner is not satisfied with the steps already taken by the respondent, he will have to approach the concerned jurisdictional magistrate under Section 152 of the Bharatiya Nagarik Suraksha Sanhita („BNSS‟), 2023 Act.

If the petitioner does so, let his grievance be looked into by the concerned magistrate with due expedition and an appropriate order be passed.

All rights and contentions of the parties are left open. 7.

The instant petition stands disposed of.
