At the outset, learned counsel for the petitioner restrict his prayer to prayer (b) only at this stage.

Briefly, on the basis of petitioner's complaint, an FIR bearing No.42/2013 registered under Section 406/420 IPC read with 120B IPC, P.S. EOW. After investigation, charge-sheet was filed against some of the accused persons whereas name of respondents No.3 to 5 were kept in column No.12 of the charge-sheet. The M.M. took cognizance only against respondent No.2 vide order dated 02.06.2016, which came to be challenged before the Sessions Court. The Session Court vide its order dated 27.04.2017 set aside the order of cognizance and remanded the matter back to the trial court for taking fresh cognizance. CRL.M.C. 1294/2020

Thereafter, the matter has been adjourned for one reason or the other. Learned counsel for the petitioner submits that vide order dated 07.07.2018, it was observed by the trial court that the arguments on cognizance was heard and the matter was adjourned for orders on 30.07.2018. He has referred to various orders passed thereafter by which the matter is listed for written argument/further arguments. Again, on 02.02.2019, the matter was heard and listed for orders on 07.03.2019. He submits that the case is still pending before the trial court at the same stage. 4.

As the FIR in the present case was lodged in the year 2013, it is directed that the concerned court shall make an endeavour to expedite the hearing in terms of the order dated 27.04.2017 passed by ASJ. 5.

The petition is disposed of.
