% 30.04.2024 I.A. 9575/2024 (under Order 23 read with Order XIII Rule 9 CPC & Section 151 CPC seeking permission/leave of this Court to withdraw the present Suit and issuance of direction for return of original documents filed by the plaintiff) 1.

The application under Order 23 read with Order XIII Rule 9 of CPC and Section 151 CPC has been filed by the plaintiff for withdrawal of the present Suit.

It is submitted in the application that the matter has been amicably settled between the parties, in terms of the Settlement dated 11.04.2024, a copy of which has already been annexed on record. It is further submitted that the payment has been received from the defendants and thus, the Suit be permitted to be withdrawn.

Learned counsel for the defendants, endorses that the parties have settled the matter.

In view of the submissions made in the application, the Suit is permitted to be withdrawn as prayed.

The original documents be returned to the plaintiff after taking certified copies on record, as per rules.
