O R D E R

% 13.05.2025 I.A. 12046/2025 (O-XXIII Rule 3 of CPC) 1.

This is a joint application filed under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 for recording of compromise arrived at between the plaintiffs and the defendant.

The application bears the signatures of the authorized representatives of the plaintiffs and the defendant as well as their respective counsel. The application is also supported by affidavits of the authorised representatives of the plaintiffs as well as the defendant.

The terms of the compromise are recorded in paragraph 2 of the application.

I have gone through the terms of the settlement and do no find the same to be unlawful.

Parties shall remain bound by the terms of the settlement. 6.

The application stands disposed of.

In view of the order passed in I.A. 12046/2025, the present suit is decreed in terms of the aforesaid application. The said application shall form part of the decree sheet.

In terms of the compromise, the defendant had handed over a cheque being No. 000130 dated 13th May, 2025 drawn on HDFC Bank, Karnal, Harana for a sum of ₹ 4 lakhs to the plaintiffs. However, today in Court, the defendant has handed over a fresh cheque of ₹ 4 lakh. 9.

Counsel for the plaintiffs submits that the cheque shall be honoured upon presentation.

Pending application, if any, shall stand disposed of. 11.

The earlier date fixed in the matter, i.e. 28th May, 2025 shall stand cancelled.
