Petitioner seeks quashing of FIR No.162/2023 dated 12.04.2023, registered at PS Tilak Nagar, Delhi, for commission of offence under Section 18 of Narcotic Drugs and Psychotropic Substances (NDPS), Act, 1985. Subsequently, charges were framed under Section 25 read with Sections 29/18(b) of NDPS Act.

The prime-most contention coming from the side of the petitioner is to the effect that there is nothing to indicate conscious recovery of the contraband in question. He submits that two witnesses have already been examined.

Fact, however, remains that charges were ascertained on 26.11.2025 and such order has never been assailed.

petitioner, without prejudice to his rights and contentions, seeks to withdraw the present petition with liberty to assail the abovesaid order dated 26.11.2025.

In view of the above, the present petition is disposed of as not pressed. Petitioner, if so advised, is always at liberty to challenge order dated 26.11.2025 in accordance with law.

Pending applications also stand disposed of.
