The learned counsel for the Additional Public Prosecutor (APP) for the State, at the outset, submits that the proceedings under Section 82 of the Code of Criminal Procedure, 1973 ('CrPC') have already been initiated against the applicant. 2.

He submits that, in such circumstances, the present application seeking pre-arrest bail is not maintainable. 3.

applicant was not aware about any proceedings being initiated against him under Section 82 of the CrPC.

He seeks liberty to withdraw the present application and take appropriate steps to challenge the issuance of process under Section 82 of the CrPC.

The present application is dismissed as withdrawn with the aforesaid liberty.
