Petitioner had filed a complaint under Section 138 of Negotiable Instruments Act, 1881.

Initially, learned Trial Court had closed the right of the accused to cross-examine CW-1 vide order dated 23.04.2025 and such order, when assailed in revision, was set aside and learned Revisional Court granted one more opportunity to the accused to cross-examine CW-1, subject to cost. 3.

The next date of hearing before the learned Trial Court is stated to be 24.04.2026 and the case was, otherwise, at the stage of Defence Evidence when the abovesaid right was reopened.

petitioner, without prejudice to his rights and contentions, does not press the present petition. He, however, submits that the learned Trial Court may be requested to give requisite priority to the abovesaid matter and to make best efforts to dispose of the same as expeditiously as possible, particularly, keeping in mind that the complainant is a senior citizen. 5.

None appears on behalf of the respondent despite advance notice. 6.

Be that as it may, in view of the above statement, the present petition is disposed of as not pressed.

All rights and contentions of the parties are left open. 8.

Learned Trial Court is also requested to expedite the disposal of the abovesaid complaint and to make best efforts to record the cross-examination of the complainant on the next date of hearing. 9.

A copy of this order be also sent to learned Trial Court for information. 10.

Pending applications also stand disposed of.
