After hearing arguments for some time, learned counsel for petitioner, without prejudice to his rights and contentions, does not press the present application.

He submits that during the trial, he would establish before the learned Trial Court that the respondent is not residing within the jurisdiction of Delhi. 3.

He, however, submits that certain application have been filed by the petitioner herein before the learned Trial Court which have yet not been considered and the delay may seriously prejudice his defence. 4.

He submits that the learned Trial Court may be requested to expedite the disposal of all such applications.

None appears on behalf of the respondent, despite advance notice. 6.

However, in view of the abovesaid, the present petition stands disposed of, as not pressed.
