Petitioner herein had earlier prayed for grant of parole and his request was rejected by the Competent Authority on 09.09.2025. 2.
Feeling aggrieved, petitioner had filed a writ petition i.e. W.P.(Crl.) 3523/2025 and when the abovesaid petition was taken up by the learned Coordinate Bench of this Court, it was brought to the knowledge of the Court that the petitioner had not completed mandatory one year of prison sentence, excluding the trial period and, therefore, he was not eligible for seeking parole.

In view of the above, the abovesaid petition was disposed of as not pressed.

Learned counsel for petitioner submits that now the petitioner has become eligible as he has completed the one year prison sentence and therefore, he is entitled to grant of parole. 5.
Fact, however, remains, that being so, he should have filed appropriate application before the concerned Authority for grant of parole. 6.

application was filed by him seeking parole, after he had become eligible. 7.
Keeping in mind the overall facts of the case, the present petition is disposed of with the direction to the concerned Authority to treat the present writ petition as representation seeking grant of parole and let appropriate decision be, accordingly, taken in accordance with law and be also duly communicated to the petitioner.

A copy of this order be sent to petitioner.
