The writ petition concerns exclusion of the petitioner's candidature from consideration for the post of Judicial Member in the Railway Claims Tribunal. It is stated in the writ petition that she was excluded from consideration, first in a selection in December 2019 and again in 2021. 2.

The petitioner has filed CM APPL. 18017/2025 for early hearing of the writ petition, on the ground that a new vacancy circular has been issued by the Railways on 27.02.2025, and the petitioner apprehends that she will again be excluded from consideration for the same reasons. 3.

With the consent of learned counsel for the parties, the writ petition is taken on Board.

the Railways on 27.02.2025, Mr. Rajeev Saxena, learned Senior Counsel for the petitioner, states that the present writ petition has been rendered infructuous and he wishes to withdraw the same, without prejudice to the petitioner's right to apply pursuant to the circular dated 27.02.2025. He also reserves the petitioner's right to challenge an order of the RCT dated 29.08.2018 in O.A. No. 359/2015, in which certain observations were made against her, and a monetary penalty was imposed upon her. 5.

The writ petition is dismissed as withdrawn, in terms of Mr. Saxena's request as aforesaid. It is made clear that this Court has not made any observation on the petitioner's eligibility or suitability for the post in question, or on the maintainability or merits of any appeal against the order dated 29.08.2018 at this length of time. 6.

All pending applications stand disposed of.
