% 19.03.2019 There are specific allegations and evidence available to show that the petitioner had used knife to inflict a life threatening injury in the abdomen of the victim Satvinder Singh, this constituting the offence under Section 307 of Indian Penal Code, 1860 (IPC) for which charge has already been found made out and framed by the trial court. The petitioner seeks release on bail on the ground of parity with co-accused Karan. Copy of the order releasing co-accused Karan has not been placed on record. Be that as it may, the additional public prosecutor explains that the role attributed to co-accused is materially distinct, he having caught hold of the victim at the time of assault. The petitioner's counsel submits that the victim Satvinder Singh is also present in court and he has agreed to condone. The fact that the petitioner is making an attempt to influence the witnesses even while trial is underway is an additional ground why the bail should not be granted.
