O R D E R

% 19.03.2019 The present criminal contempt has been marked to this Court, pursuant to directions issued by Hon'ble the Chief Justice, predicated on a Reference made by Mr. Shailender Malik, Additional District & Sessions Judge, Special Fast Track Court, North-West, Rohini Courts, Delhi (hereinafter referred to as 'the said ASJ), on 5th March, 2019. A perusal of the Reference reflects that the same was made, in relation to a case titled as "State vs. Sushma", FIR No. 11/2016, Police Station, Vijay Vihar, pending adjudication before the said ASJ. CONT.CAS.(CRL) 3/2019

Mr. Rahul Mehra, learned Standing Counsel (Criminal) appearing on behalf of the Government of NCT of Delhi, however, invites our attention to an order dated 6th March, 2019, rendered by the said Judge, whereby, a written unconditional apology made by Inspector Surender Singh Chahal, SHO, Police Station, Vijay Vihar, on whose alleged contempt, the Reference is grounded, was accepted and notice issued in that regard, dropped. In view of the foregoing, since the respondent/alleged contemnor before us, has already submitted an unconditional apology, which has since been accepted by the said ASJ, we are of the considered view that, no further proceedings are warranted in the Reference. The suo motu contempt motion is answered accordingly and disposed of.
