Learned counsel for the petitioner submitted that the petitioner is a poor lady and does not have sufficient resources to make the payment in compliance of the impugned order of the Appellate Court and the law is that in case the petitioner is not able to make the payment in terms of the impugned order, the Appellate Court may hear the matter on merits.

Learned counsel for the petitioner, after some arguments, submitted that he may be allowed to withdraw the petition. Accordingly, the petition is dismissed as withdrawn. Pending application is also dismissed as withdrawn.

It is clarified that this Court has not expressed any opinion on the merits of the present petition.
