% 28.05.2024 EX.APPL.(OS) 884/2024 1.

This is an application filed under Section 151 of CPC seeking revival of the present execution petition as the amount directed to be paid in terms of the order dated 06.05.2024 was not paid to the decree-holder. 2.

For the reasons stated in the application, issue notice. 3.

Ms. Dhawan, learned counsel accepts notice on behalf of the judgment debtor and states that two weeks further may be granted to the judgment debtor to make the full payment.

On 06.05.2024, this court granted two weeks to the judgment debtor to make the payment. The said two weeks expired on 20.05.2024 and till date the amount has not been paid.

I am of the view that once there are time lines indicated in Court order, the same are to be adhered to scrupulously and if the said time lines cannot be complied with, an application seeking extension of time needs to be moved.

In the present case, the judgment debtor cannot be permitted to sit and modify the time lines given in a Court order and make deposit as per their own whim and fancy. However, having said that as last and final opportunity two working days are granted to the judgment debtor to pay the amount to the decree-holder.

In case the amount is not deposited, this Court will be constrained to initiate action for non-compliance of the Court's order. 8.

The application is disposed of.
