The petition is for the following reliefs:

"1. direct the respondent to release the benefits under Delhi police Martyrs fund, Delhi Police Welfare Society , Family Pension, DCRG, Leave Encahment Etc. to the petitioner which accrued to her on the Death of her huaband (sub-inspector Exe,) Ram Niwas, PIS No.288850588 2. 2.

Pass any other further orders that may deem fit and just by this Hon 'ble Court in this regard."

The respondent in its counter-affidavit has stated that as per their record, the petitioner is not the nominee of the deceased Ram Niwas The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. (hereinafter 'the deceased'). It is, thus, stated that there are two nominated sons of deceased. The concerned Department, therefore, repeatedly requested the petitioner as well as nominated sons to report in the Pension Cell, DCP/T/HQ Office, for settlement of the family pension case and disbursement of the consequential benefits.

Though learned counsel for the petitioner submits that the petitioner has not received any communication, however, at this stage, the said fact may not have any relevance.

Since under the Central Civil Services (Pension) Rules, 2021, the valid nominated persons are authorized to reap the benefits of the deceased, therefore, the Court cannot issue the directions for conferment of the benefits to the petitioner who has not been nominated by the deceased. 5.

If the petitioner has any valid claim, the same will have to be adjudicated by the Court of competent jurisdiction. The petitioner, therefore, is granted liberty to avail that remedy. 6.

In view thereof, with the aforesaid liberty, the instant petition stands disposed of.
