W.P.(C) 2668/2020 The Petitioner has filed rectification petitions before the Registrar of Trade Marks, seeking rectification of registered Trade Mark No. 3172041 and Trade Mark No. 2780036 for the mark "HEPA PURE" issued in favour of Respondent No.3 - M/s Mankatsu Impex Pvt. Ltd. The only prayer is for expeditious disposal of the said rectification petitions. The counter-statement in the rectification petitions have already been filed, however, the evidence is yet to be filed. Accordingly, a timeline shall

be fixed by the Registrar of Trade Marks for filing of the evidence by way of affidavit. Upon receiving the said affidavit in evidence, as per the Trade Mark Rules, 2017, the Registrar of Trade Marks shall decide the matter expeditiously and in any case on or before 31st September, 2020. With these observations, the petition and all pending applications are disposed of.
