C.M. APPL. 75644/2024 is an application preferred on behalf of the Petitioner under Order VI Rule 17 CPC seeking amendment in the prayer clause of the writ petition.

Mr. Anurag Mathur, learned counsel appearing on behalf of Respondents No.2 and 3/BSNL points out that the request of the Petitioner for accepting his Technical Resignation was rejected vide order dated 28.02.2023 but there is no challenge to the said order in the present writ petition.

At this stage, on instructions, Mr. Sudarshan Rajan seeks to withdraw the application and the writ petition with liberty to file a comprehensive writ petition inter alia laying a challenge to the order rejecting his request for technical resignation.

The writ petition and the application are disposed of as withdrawn with liberty to the Petitioner to file a fresh writ petition on the same cause of action as also for challenging order dated 28.02.2023 by which his request for accepting the technical resignation was rejected, in accordance with law. C.M. APPL. 75641/2024 5.

Application stands disposed of in the aforesaid terms. 6.

Date of 23.04.2025 stands cancelled.
