Respondent No.1 is stated to have passed away. Appellant seeks an adjournment to implead the LRs of Respondent No.1, if any. The appellant had preferred the instant suit seeking damages against Respondent No.1 based on a collaboration agreement. The Trial Court has observed that the demolition of the construction had taken place due to the non-sanctioning of the site plan which was attributed to the Appellant/ Plaintiff. Thus, the Trial Court held that the Appellant/Plaintiff is not entitled to any compensation from Respondent No.1. It is the Appellant's case that the onus of getting the plan sanctioned was upon the owner and not the developer. Appellant to address arguments on the next date i.e. 24th April, 2018.
