% 20.11.2019 Mr. Hossain has taken instructions. He has placed before this Court the communication dated 06.11.2019 issued to him by the Assistant Commissioner of Income Tax, Circle-2(1)(2), International Taxation, New Delhi, wherein it is stated that as per resolution order passed by the Joint Secretary (FT&TR-I) & Competent Authority of India on 23.08.2019 under the Mutual Agreement Procedure in the case of JC Bamford Excavator Limited, the assessee company has given its acceptance to MAP resolution dated 23.09.2019. Consequently, learned counsel has been instructed to withdraw the present appeal.

In the light of the aforesaid, the present appeal is dismissed as withdrawn.
