Counsel for the parties submit that the parties have settled the dispute in mediation proceedings before the Delhi High Court Mediation and Conciliation Centre ('Mediation Centre').

The Settlement Agreement dated 28th July, 2025, (hereinafter 'Settlement Agreement') which bears the signatures of the authorised representatives of the plaintiff and the defendant, has been placed on record. 3.

In view of the aforesaid settlement, the plaintiff seeks to withdraw the CS(COMM) 255/2022 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 14/10/2025 at 12:57:22

present suit.

Accordingly, the suit is dismissed as withdrawn. 5.

In view of the fact that the matter has been settled at the Mediation Centre, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff, in terms of Section 16 of the Court Fees Act, 1870 read with Section 89 of the Code of Civil Procedure, 1908. I.A. 25094/2025 (seeking intervention in the present suit) 6.

This application has been filed on behalf of the intervenor/applicant seeking intervention in the present suit.

The settlement arrived at between the plaintiff and the defendant as noted above, would be without prejudice to the rights and contention of the applicant.

In view thereof, counsel for the applicant does not press this application.
