Learned counsel for respondent submits that he has no objection to this application. Learned counsel for petitioner also submits that he has no objection if the amount of Rs. 1,00,000/- lying deposited with the trial court in compliance with order dated 26.04.2023 of this Court is released to the present respondent/plaintiff.

Accordingly, the application is allowed and it is directed that the amount of Rs. 1,00,000/- with interest accrued, lying deposited with the trial court in compliance with order dated 26.04.2023, be released to the respondent/plaintiff.

Consequently, the petition is dismissed as withdrawn. Date of 09.02.2026 stands cancelled.
