O R D E R

% 05.06.2020 Pursuant to the proceedings dated 01.06.2020, the verification report has been submitted by the State in relation to the ailment of the wife of the applicant. The said status report dated 02.06.2020 submitted under signature of Inspector Prem Chandra, Crime Branch vouches the factum of the wife of the applicant requiring to have a surgery and hospitalization for three days in relation to ailment of the applicant's wife i.e. Bleeding piles with Br. Asthma. As per the said status report that has been submitted it is indicated that the recovery time is two months.

On behalf of the applicant it has been submitted that the said surgery is imminent and that there is no one else in the family of the applicant to look after the applicant's wife post-surgery and also for the surgery. On behalf of the State it is submitted through the status report that has been submitted that there is a son aged 22 years pursuing B.Tech, final year, Computer Science from Krishna Engineering College, Ghaziabad, another son aged 19 years named Tanisq Garg who however suffers from Cerebral

Palsy by birth and that there are brothers of the applicant named Ajay Garg, Anil Garg and Arun Garg living separately with their respective family at Aligarh, Noida and Ghaziabad respectively and that his brother Ajay Garg resides in the near vicinity of the applicant and runs a business of hardware in the name of M/s JP Enterprises in Aligarh itself. The application is opposed on behalf of the State submitting inter alia to the effect that the allegations levelled against the applicant are grave in relation to the alleged commission of offences punishable under Sections 22/29 of the NDPS Act, 1985.

On a consideration of the rival submissions that have been made, taking into account that the applicant seeks the grant of interim bail for the treatment of the ailment of his wife, which is clearly brought out to be in existence through the status report submitted by the State, the applicant is allowed to be released on interim bail for a period of 45 days from the date of his release on submission of a bail bond for Rs.50,000/- with one surety of the like amount to the satisfaction of the Superintendent Jail, Delhi with directions that  he shall not leave the country;

 he shall keep his mobile phone on at all times;  he shall inform the Superintendent of Police, Aligarh of his presence on every 7th day of the period during which he is on interim bail and  he shall surrender on the 45th day of his release before the Superintendent Jail, Delhi, The application is disposed of.
