W.P.(C) 654/2016 Present writ petition has been filed seeking a direction to respondents to issue Passport to the petitioners who are minors. Petitioners further seek quashing of the order dated 16th June, 2014, whereby the applications filed by the petitioners' for issuance of Passports were rejected on the ground that their parents had sought asylum in Canada.
Learned counsel for petitioners states that they had filed an appeal against the order dated 16th June, 2014 and despite personal hearing having been granted on 19th December, 2014, respondent No.2 has till date not passed any order.
Issue notice.
Mr. Rajesh Gogna, learned counsel accepts notice on behalf of respondents.
Keeping in view the fact that the appeal filed by the petitioners is still stated to be pending, the Chief Passport Officer is directed to decide the said appeal within a period of four weeks of receipt of the order. In the event, the Chief Passport Officer requires any fresh hearing and/or documents, it shall be open to him to give notice to the petitioners to appear through counsel and/or authorised representative on a particular date.
