% 27.04.2026 By way of the present petition filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks further extension of interim bail granted vidé order dated 30.03.2026 in BAIL APPL. No. 1208/2026.

In line with the view taken by this Bench in Jatin vs. The State NCT of Delhi in BAIL APPL. No. 3418/2024, an application for extension of interim bail is to be filed in the original petition, in which the interim bail was first granted; and not by way of a fresh petition. transpires that since the present matter was received on transfer from a Co-ordinate Bench, to obviate further delay, vidé order dated 17.04.2026, this court had issued notice on the present petition; and had directed the State to file their status.

On the subsequent date i.e., 23.04.2026, Mr. Varun Deswal, learned counsel for the petitioner had handed-up the prescription of a different medical facility, viz. Max Super Speciality Hospital, Saket; whereupon this court had also directed the State to verify that prescription and file an additional status report.

Though the present petition ought not to have been entertained as a fresh petition in the first place, since the matter was entertained by the Predecessor Bench and has gone-on for sometime, this court deems it appropriate to continue hearing the present petition. 5.
It is however made clear that the ruling in Jatin vs. The State NCT of Delhi shall continue to be applied in other cases. 6.
Mr. Akhand Pratap Singh, learned SPP for the State has handed-up a copy of Additional Status Report dated 27.04.2026. The same is taken on record. Enclosed with the additional status report is the response given by the attending doctor at Max Super Speciality Hospital, Saket. 7.
Upon a perusal of the response given, it transpires that by reason of his earlier medical condition, the petitioner had undergone Coronary Artery Bypass Grafting (CABG) on 10.03.2026; and thereafter, he was discharged on 16.03.2026.

Subsequently however, since the petitioner complained of chest pain and other related symptoms, he was re-admitted to Max Super Speciality Hospital, Saket on 10.04.2026;but he went 'lama' on The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
13.04.2026. Mr. Deswal submits, that the petitioner was compelled to leave Max Super Speciality Hospital, Saket only to get himself admitted to Kalra Hospital SRCNC Pvt. Ltd., Kirti Nagar, New Delhi, since he ran-out of funds and could not afford to remain admitted at Max Super Speciality Hospital.

Later, the petitioner went back for review in OPD to Max Super Speciality Hospital, Saket on 21.04.2026, at which point he is stated to have been in 'stable' clinical condition but was advised bed-rest and medication for 30 days.

To a pointed question as to whether the petitioner requires assistance to perform his daily chores and whether he would be able to manage his daily routine inside jail, the attending doctor has said the following : "Assistance if any, ability to perform chores, manging (sic, managing) daily routine from inside jail with medication depends on Patient's current clinical condition."
11. In the circumstances, Mr. Deswal submits, that the petitioner's interim bail be extended for some reasonable period of time, so that his medical condition stabilises.
12. Mr. Singh, on the other hand submits, that though the petitioner appears to be in stable medical condition even now, this court may pass appropriate orders.

On a conspectus of the foregoing, the present petition is disposed-of granting to the petitioner extension of interim bail for a period of 02 weeks from today on the same conditions as were imposed vidé order dated 21.01.2026 passed by the learned Special Judge, NDPS, Central District, Tis Hazari Courts, Delhi.
