The present writ petition has been filed seeking a direction to respondent no.1/MCD to act upon the complaint dated 20th January 2026, made by the petitioner regarding unauthorised construction/closure of the common ventilation shaft and removal of the water tank at Property No. R30, Ramesh Park, Laxmi Nagar, Delhi - 110092 (hereinafter 'subject property').

Along with the petition, the petitioner has filed photographs showing unauthorised construction on the roof of the third floor of the subject property, which has resulted in the blocking of the shaft. 3.

Counsel appearing on behalf of the respondent no.1/MCD submits that the shaft has been cleared/unblocked. inspection, unauthorised construction was found at the subject property. 4.

In view thereof, the present petition is disposed of while directing respondent no.1/MCD to take appropriate action in accordance with law. 5.

Pending application also stands disposed of.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

All rights, contentions and legal remedies of the owner/occupier/private respondent are kept open.
